Welcome to Sethi Couture. These Terms & Conditions (“Terms”) govern your access to and use of sethicouture.com (the “Site”) and your purchase of products from Sethi Couture (“Sethi Couture,” “we,” “us,” or “our”).
By accessing or using our Site or placing an order through the Site, you agree to these Terms. Please read them carefully.
1. USE OF OUR SITE
You may use our Site only for lawful purposes and in accordance with these Terms.
You agree not to misuse the Site, interfere with its operation or security, attempt to gain unauthorized access to the Site or related systems, use automated means to improperly access or collect information from the Site, or use the Site in a manner that violates applicable law or the rights of Sethi Couture or others.
We reserve the right to restrict or terminate access to the Site if we reasonably believe these Terms have been violated.
2. PRODUCTS
Sethi Couture offers fine jewelry and related products through our Site.
We make reasonable efforts to display and describe our jewelry as accurately as possible. Because our pieces are made with natural diamonds, gemstones, precious metals, and handcrafted elements, individual pieces may have subtle variations in color, appearance, texture, dimensions, stone characteristics, or finish.
These natural and handcrafted variations are part of the character of fine jewelry and are not necessarily considered defects.
Product photographs are intended to represent our jewelry as accurately as possible. However, colors and scale may appear differently depending on photography, lighting, screen settings, device displays, and other factors.
Measurements, dimensions, carat weights, and other product specifications may be approximate unless expressly stated otherwise.
3. AVAILABILITY
All products are subject to availability.
An item appearing on the Site does not guarantee that it is currently available or available in a particular size, metal, stone configuration, or quantity.
We reserve the right to discontinue products or modify product offerings at any time.
If an item becomes unavailable after you place an order, we will contact you and may offer an alternative, provide an updated delivery estimate, or cancel and refund the affected portion of your order.
4. ORDERS AND ORDER ACCEPTANCE
Submitting an order through our Site constitutes an offer to purchase the products included in your order.
Receipt of an order confirmation does not necessarily constitute our final acceptance of the order.
We reserve the right to accept, decline, limit, or cancel an order when reasonably necessary, including in circumstances involving:
- Product availability;
- Pricing or product-information errors;
- Suspected fraud or unauthorized transactions;
- Payment authorization issues;
- Orders that appear to be placed for unauthorized resale;
- Shipping restrictions; or
- Other circumstances that reasonably prevent us from fulfilling the order.
If we cancel an order after payment has been processed, we will issue an appropriate refund to the original method of payment.
5. PRICING
Prices displayed on the Site are shown in the currency indicated and may change without notice.
Because fine-jewelry pricing can be affected by precious-metal, diamond, gemstone, production, and other costs, we reserve the right to adjust prices at any time before an order has been accepted.
We make reasonable efforts to ensure that pricing and product information is accurate. Occasionally, typographical, technical, or other errors may occur.
If we discover a material pricing or product-information error after you place an order, we may contact you to provide the correct information and give you the opportunity to proceed with or cancel the order. We may also cancel an order affected by an obvious error and refund amounts paid.
Applicable sales taxes and other charges will be calculated as required and displayed during checkout when applicable.
6. PAYMENT
Payment must be made using one of the payment methods offered at checkout.
Sethi Couture does not store your complete credit card or debit card information. Payments made through the Site are processed by Shopify and/or third-party payment providers.
By submitting payment information, you represent that you are authorized to use the payment method provided.
We reserve the right to take reasonable steps to verify an order or payment before fulfilling an order.
7. SHIPPING AND DELIVERY
Shipping options, estimated fulfillment times, delivery information, and applicable charges are provided during checkout or in our Shipping Policy.
Delivery dates and shipping times are estimates unless expressly guaranteed. Delays may occur due to carrier issues, weather, holidays, customs processing, product availability, production requirements, or other circumstances outside our reasonable control.
For made-to-order, special-order, resized, personalized, or otherwise customized jewelry, production and delivery times may differ from those for in-stock merchandise.
International customers may be responsible for duties, taxes, customs charges, brokerage fees, or other charges imposed by the destination country unless otherwise stated at checkout.

8. RETURNS AND EXCHANGES
Returns and exchanges are governed by our current Return Policy, which is incorporated into these Terms by reference.
Eligibility for return or exchange may vary depending on the product and circumstances.
Certain merchandise, including customized, altered, resized, engraved, special-order, final-sale, or otherwise personalized merchandise, may be ineligible for return or exchange as described in our Return Policy.
Please review the Return Policy before making your purchase.
Nothing in these Terms or our Return Policy limits rights that cannot legally be waived under applicable consumer-protection law.
9. RING SIZING AND ALTERATIONS
Customers are responsible for selecting the appropriate ring size when placing an order.
Because many Sethi Couture designs feature diamonds or design elements around all or a substantial portion of the band, certain rings may have limited resizing options or may not be resizable.
If you are uncertain about sizing, we encourage you to contact us before placing your order.
Resizing, alteration, engraving, or other customization may affect a product's eligibility for return or exchange.
10. PROMOTIONS AND DISCOUNT CODES
Promotions, offers, and discount codes may be subject to additional terms disclosed at the time of the promotion.
Unless otherwise stated, promotions:
- Cannot be combined with other offers;
- Have no cash value;
- May exclude certain products or categories;
- May be limited to a specified time period; and
- May be modified or discontinued as permitted by applicable law.
We reserve the right to cancel or refuse a promotion that has been obtained or used through fraud, abuse, technical error, or violation of the promotion's terms.
11. GIFT CARDS
If Sethi Couture offers gift cards, their purchase and use may be subject to additional terms provided at the time of purchase.
Gift cards are not redeemable for cash except where required by applicable law.
12. CARE, REPAIRS AND NORMAL WEAR
Fine jewelry requires appropriate care.
Jewelry may naturally show signs of wear over time. Precious metals can scratch, finishes may change with wear, and settings and stones may require periodic inspection or maintenance.
Damage resulting from accidents, impact, improper care, normal wear, unauthorized repairs or alterations, or other circumstances unrelated to a manufacturing defect may not be considered a product defect.

13. INTELLECTUAL PROPERTY
All content appearing on the Site, including jewelry designs, photographs, images, graphics, logos, trademarks, product names, collection names, text, videos, artwork, Site design, and other content, is owned by or licensed to Sethi Couture and is protected by applicable intellectual-property laws.
You may access the Site and its content for your personal, non-commercial use.
You may not reproduce, distribute, modify, publish, display, sell, create derivative works from, commercially exploit, or otherwise use our content without our prior written permission except as permitted by applicable law.
Nothing on the Site grants you any license or right to use Sethi Couture trademarks, trade dress, designs, or other intellectual property without our written authorization.
14. USER CONTENT
If you submit reviews, photographs, comments, feedback, testimonials, social-media content, or other materials to us or expressly authorize us to use such materials, you represent that you have the right to provide them.
Where you grant us permission to use content, we may use that content in accordance with the permission granted and applicable law.
You may not submit content that infringes another person's intellectual-property, privacy, publicity, or other rights or that is unlawful, fraudulent, abusive, or otherwise inappropriate.
15. THIRD-PARTY SERVICES AND LINKS
Our Site may contain links to or integrate with websites, platforms, payment services, social-media services, and other services operated by third parties.
We do not control these third-party services and are not responsible for their content, availability, privacy practices, or terms.
Your interactions with third-party services are governed by the terms and policies of those third parties.
16. SHOPIFY
Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer products through the Site.
Certain Shopify services, including Shop Pay or other Shopify consumer services, may be subject to separate terms between you and Shopify.
Sethi Couture remains responsible for its products, fulfillment, customer service, returns, and its transactions with customers as required by applicable law.
17. PRIVACY
Your privacy is important to us.
Our collection, use, disclosure, and protection of personal information is described in our Privacy Policy.
Your submission of personal information through the Site is governed by our Privacy Policy and applicable law.
Our Site may use cookies and similar technologies as further described in the Privacy Policy. Where available, you may manage non-essential cookies and certain data-sharing preferences through the privacy controls provided on our Site.
18. MESSAGING
By opting in to SMS you agree to receive recurring automated promotional and personalized marketing text messages from Sethi Couture at the number provided. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for assistance. Consent is not a condition of purchase.
19. WEBSITE INFORMATION
We make reasonable efforts to keep information on our Site accurate and current. However, we do not warrant that all Site content will always be complete, accurate, current, or error-free.
We may correct errors, update information, or make changes to the Site at any time.
20. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by applicable law, the Site and its content are provided on an “as is” and “as available” basis.
We do not warrant that the Site will always operate without interruption or error or that it will be free from harmful components.
Nothing in this section excludes warranties or consumer rights that cannot legally be excluded or limited.
21. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Sethi Couture and its affiliates, officers, directors, employees, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of products.
To the extent permitted by law, Sethi Couture's aggregate liability arising from a particular purchase will not exceed the amount you paid to Sethi Couture for the product giving rise to the claim.
These limitations do not apply where liability cannot legally be limited or excluded.
22. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless Sethi Couture and its affiliates, officers, directors, employees, and representatives from claims, liabilities, damages, and reasonable costs arising from your unlawful use of the Site, your violation of these Terms, or your infringement of another person's rights.
23. ACCESSIBILITY
We are committed to diversity, inclusion, and meeting the needs of all of our customers, including those with disabilities and therefore strive to make our website accessible. We are continually improving our website to comply with the accessibility guidelines in WCAG 2.0 AA. Further efforts are currently in the works and we continue to update our website to improve accessibility. 24. GOVERNING LAW
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable consumer-protection laws provide otherwise.
Nothing in these Terms is intended to limit any rights you may have under mandatory consumer-protection laws applicable to you.
25. SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.
26. NO WAIVER
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.
27. TRADEMARKS
Sethi Couture® and Elevate the Everyday® is a registered trademark. The trademarks, logos, service marks and trade names of Sethi Couture and our affiliates may not be used without our written permission.
28. TERMINATION
Sethi Couture may without prior notice, immediately terminate your Sethi Couture account and access to the website. Cause for such termination shall include: (a) breaches or violations of the Terms of Use or other incorporated agreements or guidelines; (b) requests by law enforcement or other government agencies; (c) a request by you (self-initiated account deletions); (d) discontinuance or material modification to the website (or any part thereof); (e) unexpected technical or security issues or problems; (f) extended periods of inactivity; (g) engagement by you in fraudulent or illegal activities; and/or (h) nonpayment of any fees owed by you in connection with the website or any Sethi Couture product.
Further, you agree that all terminations for cause shall be made in Sethi Couture’s sole discretion and that Sethi Couture shall not be liable to you or any third party for any termination of your account, any associated email address, or access to the website.
29. CHANGES TO THESE TERMS
We may update these Terms periodically to reflect changes to our business, Site, products, practices, or legal requirements.
Changes will be posted on this page with an updated “Last Updated” date.
The Terms in effect at the time of your transaction will generally govern that transaction, except where applicable law requires otherwise.
